Rules for meeting with respect.
These terms govern access to and use of Vapai. The app is exclusively for people aged 18 or older.
1. Operator and acceptance
These terms form an agreement between you and Raftell SAS, tax ID (RUT) 020594010017, at Calle Gaviotas, Manzana 48, Solar 11, Parque Solymar, Ciudad de la Costa, Canelones, postal code 15005, Uruguay. Vapai is developed under LosHermanosPatos and legally operated by Raftell SAS.
You must be at least 18 years old, able to enter a contract and legally permitted to use the service where you are. You may not use Vapai if suspended or prohibited by law.
Account and verification
You must provide accurate information, keep it updated and protect your credentials. Date of birth is self-declared. SMS confirmation only confirms access to a phone: it does not verify identity or age. Vapai may add Apple or Google age signals in the future without presenting them as complete verification.
2. How Vapai works
Vapai helps people discover each other through experiences. A person may show interest and, if the host accepts, both can match and use chat to coordinate. You must give separate consent before sensitive preferences take part in compatibility or discovery.
We do not guarantee a match, response, acceptance, meeting, compatibility, experience availability or a particular outcome. Users independently decide whether to interact or meet.
Registration is globally available; Barcelona is the first city planned to have active experiences. Features may vary by city, operating system or launch phase.
3. Your content and conduct rules
You retain rights in what you post. You grant us a non-exclusive, worldwide, royalty-free licence limited to hosting, displaying, operating, protecting and moderating that content to provide Vapai. It ends when you delete the content, except for temporary backups, necessary evidence or retention required by law.
You confirm that you have all necessary rights and permissions. You must not post or carry out:
- impersonation, scams, fraud, spam or abusive automation;
- threats, harassment, hate, discrimination or illegal content;
- sexualisation of minors or any sexual interaction with minors;
- non-consensual intimate images, extortion or exploitation;
- content infringing intellectual property, privacy or other rights;
- payment fraud or attempts to bypass security controls.
Vapai's brand, software, design and original materials belong to Raftell SAS or its licensors. You may not copy, decompile or exploit them unless mandatory law permits it.
4. Reports, blocks and enforcement
You may report profiles, content or experiences. Vapai may review relevant information and remove content, limit visibility, suspend, block or close accounts to protect the community, comply with law or enforce these terms. Measures may be temporary or permanent and will be proportionate where possible.
You may appeal by emailing support@vapai.me. Include the account email or phone and the disputed decision, but never passwords or access codes.
Global blocking across every product surface must be technically verified before public launch.
5. Meetings, experiences and future payments
Vapai is not an emergency service, does not supervise in-person meetings and cannot verify every claim by another person. Read the Safety Center, choose a public place and contact local emergency services if there is immediate danger.
At launch there is no commercial partner, checkout or active booking. Partner experiences, prices, bookings, payments, refunds and cancellations are future and conditional features. If enabled, we will show who sells or provides the experience, the total price, specific conditions and responsibilities before purchase. Vapai will not receive or store complete card numbers, PAN or CVV.
The commercial model, merchant status, commissions, taxes, payments, cancellations, refunds and partner terms remain undefined and unapproved.
6. Availability, termination and liability
You may stop using Vapai and delete your account. We may also limit or end access for breach, safety risk, legal obligation, technical unavailability or service closure. Where appropriate, we will explain the reason and provide an appeal path.
We provide the service with reasonable care, but it may be interrupted, contain errors or change. We do not endorse or guarantee every person, item of content or experience. To the extent allowed by law, we are not liable for indirect or unforeseeable losses or independent third-party conduct.
Nothing here excludes non-waivable consumer rights or liability that cannot legally be limited, including for fraud, gross negligence, death or personal injury where applicable.
7. Law, disputes, language and changes
The proposed approach is Uruguayan law, always preserving mandatory rules and consumer rights in the country of residence. Consumers may use any courts legally available to them locally. For non-consumer use, the competent Uruguayan courts are proposed. No private arbitration or ADR scheme is proposed.
Before making a claim, you can email support@vapai.me. Spanish and English versions are intended to be equivalent; if they differ, the Spanish version is proposed to prevail without limiting mandatory rights.
We may update these terms for legal, technical or product changes. We will communicate material changes and seek renewed acceptance where appropriate. The version shown at the start is the applicable version.
This entire section —governing law, jurisdiction, dispute resolution and language precedence— must be validated by legal counsel before launch.
